Terms & Conditions of Sale
PLEASE READ THESE TERMS AND CONDITIONS OF SALE ("SALE AGREEMENT") VERY CAREFULLY. THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS.

IMPORTANT INFORMATION ABOUT THIS LEGAL CONTRACT: This Sale Agreement is a legal contract between the Customer and Vertical Visions LLC. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on this Site. (References to "you" or "your" shall relate to the Customer; references to "Vertical Visions" shall relate to Vertical Visions LLC.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question. This Sale Agreement constitutes the entire agreement between the Customer and Vertical Visions relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by Vertical Visions. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting Vertical Visions. In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sale Agreement and our invoice shall control.

GOVERNING LAW: THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF WEST VIRGINIA, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN HARRISON COUNTY, WEST VIRGINIA FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.

TITLE, RISK OF LOSS: Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser.

PRICING AND INFORMATION DISCLAIMER: All pricing is subject to change. For all prices, products and offers, Vertical Visions reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances. High volume bids are welcome. While Vertical Visions uses reasonable efforts to include accurate and up-to-date information on the Site, Vertical Visions makes no warranties or representations as to the Site's accuracy. Vertical Visions assumes no liability or responsibility for any errors or omissions in the content on the Site.

LIMITATION OF LIABILITY: VERTICAL VISIONS WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN. VERTICAL VISIONS WILL NOT BE LIABLE FOR PRODUCTS OR SERVICES NOT BEING AVAILABLE FOR USE. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES, VERTICAL VISIONS IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE(S) UNDER THIS AGREEMENT. VERTICAL VISIONS WILL NOT BE LIABLE FOR ANY EQUIPMENT DAMAGE, INJURY, OR LOSS OF LIFE RESULTING FROM THE USAGE OF ANY PRODUCT ON THIS SITE.

ORDERS, PAYMENT TERMS, INTEREST, TAXES: Orders are not binding upon Vertical Visions until accepted by Vertical Visions. Terms of payment are within Vertical Visions' sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. Vertical Visions may invoice parts of an order separately. Customer agrees to pay interest on all past-due sums up to the highest rate allowed by law. The Customer is responsible for sales and all other taxes associated with the order.

PAYMENT POLICY: Vertical Visions accepts the following forms of payment for the purchase of goods or services:

  • MasterCard and Visa credit cards. Credit cards will not be charged until your order is ready for shipment, unless product customization is required. Vertical Visions does not apply any surcharge for credit cards. Bridge Day orders will be charged during registration in order for us to begin work on ID badges, T-shirts, and other critical information needed to continue our work in making this a great event.
  • Electronic checks. Electronic checks are processed in the same manner as credit cards and can be performed over the phone or via our webstore.
  • Personal checks or cashiers checks drawn on US funds. Please allow at least 10 business days for personal checks to clear before package shipment.
  • Money orders drawn on US funds.
  • Wire transfer. Please contact us for details.

SHIPPING: Most orders are shipped within 24 hours via United Parcel Service (UPS) or United States Postal Service (USPS). Some orders may require additional packaging time due to customization of parts. We will email or call you when your package has been shipped and provide package tracking details if they are available. Average delivery times are as follows (delivery times for international orders may vary depending on location):

    Domestic Shipments
  • USPS Priority Mail: 2-3 days.
  • UPS Ground: 1-6 days (dependent on your location, see map below).
  • UPS 2nd Day: Two (2) days from shipment.
  • UPS Next Day Air: Packages will arrive the following day after shipment.
    International Shipments
  • USPS Air Mail: 4-7 days.
  • USPS Global Priority: 3-5 days.

RETURN POLICY: Please contact us to obtain a Return Merchandise Authorization (RMA) number before shipping defective or non-defective products back to Vertical Visions. NO returns of any type will be accepted without an RMA number. For faster service, please include the following information when emailing your request for an RMA number: Customer Name, Invoice Number, and nature of the problem.

  • All products returned MUST: be 100% complete, contain ALL original boxes and packing materials, contain all manuals, and contain other accessories and documentation provided by the manufacturer.
  • You are responsible for shipping charges on returned items; Vertical Visions will match your shipping method on your replacement or exchange item(s).
  • Vertical Visions strongly recommends you fully insure your return shipment in case it is lost or damaged and you use a carrier that can provide you with proof of delivery for your protection. If merchandise arrives damaged: it is best to REFUSE it back to the carrier attempting delivery. If you accept the package, make sure it is noted on the carrier's delivery record in order for Vertical Visions to file a damage claim. Save the merchandise AND the original box and packing it arrived in, notify Vertical Visions immediately to arrange for a carrier inspection and a pick up of damaged merchandise. If you do not notify Vertical Visions of damaged goods within the first 15 days of arrival, our regular return policy will override any claim of damage. Contact us to arrange for carrier inspection and a pick up of damaged merchandise.
  • Defective returns can be returned to Vertical Visions within 30 days from the invoice date for: Credit, replacement, exchange or repair. Videos that have been opened and viewed can only be returned if defective.
  • Non-defective returns can be accepted by Vertical Visions within 30 days from the invoice date, at Vertical Visions' discretion for: refund, credit, replacement , exchange, or repair. All non-defective returns are subject to a 15% restocking fee.
  • Vertical Visions reserves the right to authorize product returns beyond 30 days from the invoice date. If the product is accepted after 30 days, credit will be issued toward future purchases only. Original shipping charges are not refunded on returned items. Customers are responsible for all shipping charges back to Vertical Visions on returned items, and Vertical Visions will pay the shipping charges on the replacement or exchange item(s) sent back to customer.

BRIDGE DAY REFUNDS, EVENT POLICIES:

  • Full refunds will be provided to jumpers if they fail the Bridge Day background check performed in early September. Since 2002, no one has failed the background check.
  • In the event of the cancellation of the BASE Gear Trade Show, full refunds will be provided to those who purchased vendor booths. No refunds will be provided for voluntary cancellations or a failure to appear at the event.
  • No refunds will be provided to registrants who voluntarily cancel their jump slots, first jump training courses, or introductory training courses. No refunds will be provided if weather delays or cancels jumping, if you don't show up for Bridge Day, if you are unable to jump due to slow lines or other circumstances, if you are scared and/or refuse to jump on Bridge Day for any reason, or if Bridge Day is cancelled prior to September 1.
  • If Bridge Day is cancelled prior to September 1, refunds less expenses will be provided to jumpers who send us a self-addressed stamped envelope.
  • Jump passes are not transferable and credit will not be provided if you cannot attend Bridge Day.
  • If you fail to bring your own 2x2 photo for your ID badge, we will have a staff photographer available to take your photo for a $15 fee.
  • Vertical Visions reserves the right to revoke your jump pass and provide a full refund at any time, for any reason. Common reasons include, but are not limited to: Lying on your application to jump or rent gear, a history of unsafe skydives or BASE jumps, drug or alcohol use during onsite registration or Bridge Day, failure to meet jumper requirements, a history of lawsuits filed against anyone in the parachute industry, etc.
  • We will charge jumpers a $50 late fee if they fail to show up for jumper onsite registration at the Holiday Inn in Fayetteville, WV by 5pm EDT on the day prior to Bridge Day (Friday). If you require us to take your photo for your ID badge, there will be an additional $25 charge. No exceptions. These fees are necessary to deter late onsite registrations, as we are always VERY busy on Friday night and Bridge Day morning.
